Ralph Bailey vs. Realty Ingenious Song

It is of my God given, forefather written Amereican right to my opinion that Ralph Bailey, is an uninformed, illiterate, ignorate over opinionatd jackass. But then again as an american himself he has that right. He reads from the book about what slander is, well he should get an actual lesson in what slander and liabel is. As defined by law:

LIBEL AND SLANDER occur when a person or entity communicates false information that damages the reputation of another person or entity. Slander occurs when the false and defamatory communication is spoken and heard. Libel occurs when the false and defamatory communication is written and seen. The laws governing libel and slander, which are collectively known as DEFAMATION, are identical.

A plaintiff who wishes to sue an individual or entity for libel or slander has the burden of proving four claims to a court: First, the plaintiff must show that the DEFENDANT communicated a defamatory statement. (THIS WAS DONE) Second, the plaintiff must show that the statement was published or communicated to at least one other person besides the plaintiff. (THIS WAS DONE)Third, the plaintiff must show that the communication was about the plaintiff and that another party receiving the communication could identify the plaintiff as the subject of the defamatory message. (THIS WAS NOT DONE, NO NAMES WERE EVER MENTIONED) Fourth, the plaintiff must show that the communication injured the plaintiff's reputation.(THIS WAS NOT DONE, THE PERSON IN QUESTION, WHICH NAME I WILL NOT MENTION, REPUTATION WAS ALREADY DAMGED BY HAVE THE SAID COMMENTS DONE.)

There are four general defenses to slander and libel. Truth is an absolute defense. The person in question has been blasted on TV, Radio, Podcasts, Webcasts, Websites, Blogs and Newspapers for his foreclosures, overextensions on mortgages, several mortgages on properties that will go into forclosure, the hole just gets bigger and bigger "

Well Mr. Bailey, that is fact and opinion and it is mine, you had yours and I think its wrong, and illinformed and ignorant, and even with your rant not opinion could be viewed toward the end as an idle threat. Just my Two Cents

Techno/Trance Artists Can Create Any Music

Other forms of music are not beyond the scope of Nemo, I have released 2 other tracks. That are completely different from the typical electronica. "Kalli Girl" dedicated to my awesome sister. "Summer Vibe" just a summer jam, got that feall good spirit. Look for other rock, surf, or what ever I feel like tracks.

Unsung Bakersfield Christmas Heroes

There is a small website group on Yahoo called BFREE4ALL. This a very very large group of people in and around Bakersfield, where one mans Junk is another man's treasure. People go here to find things they need that someone may have and want to get rid of, or they may not want it anymore or don't have the room and post to first come first serve.

For example, I run a very small business out of home, and have a large family, so the budget is usually tight. I posted if anyone had a fax machine they weren't using, that would be great. I got response right away, Another, someone posted they needed a computer power supply for a school project I had one I had never used, still in the box and offered it to them, they were pretty grateful. No money exchanges hands just goods. It's a win, win, win situation, Someone gets rid something gathering dust, someone gets something they need or want, and the landfills stay that much more empty.

Well on to the reason for this site and blog. Two of the Moderators help to put together what has become know as Project Santa. Right after Thanksgiving Debera (a local Realtor) and Tammy (a stay at home mom) start taking donations for kids who don't have the fortune to have a great Christmas. The parents, grandparents, even a few concerned neighbors, sign up the kids, Last year around a dozen kids had a happier Christmas, this year, 45 kids ranging in all ages are gonna have a happier Christmas. Kids will get anywhere from 2 to 4 donated toys, a few will also get some nice Christmas clothes, a few single moms may get a little something, and all kids will get stocking stuffers. One family even received an artificial tree, where they weren't going to have any tree at all. This years intake was pretty good, even had a nice donator at the last minute, donate 1 toy for each child. The parents or whoever else ask for some certain things, but that doesn't always happen, some are Really grateful, others offers quick thank you, (I think these people are swallowing their pride alot just ask for help). All the donates are wonderful people and should be applauded. But the 2 women who take their time out of their busy schedule and own families during this time of year are without a doubt angels, Today it December 23rd and they are out now handing out the gifts.

It's nice to hear there is still great humanity left in this city, many people complain that Bakersfield is becoming another LA, sure it has it problems, but the giving we see like this doesn't happen in LA or other large cites, this purely Bakersfield, OUR BAKOTOPIA

One of your friends owns a house on a spot where you had field parties in high school.

You get mad every time you see, "Best of Times" when Taft wins at the end. ..or... you get mad every time you see "Best of Times" because who the hell are the Bakersfield Tigers?

You comment on how expensive Mexican food is in any other city in the country.

You have ever offered someone a Dewar's Chew from a bowl on your coffee table.

You claim to hate LA but go there at least every other month.

You have ever debated the merits of water skiing at Lake Ming versus Buena Vista.

You have to explain to friends from out of town what animal a tri-tip comes from.

Y ou think beans and salsa go with everything.

You think a restaurant is chintzy if it doesn't come with soup, salad, spaghetti, and fries.

You think a red light is just a suggestion.

The best restaurants in town serve pickled tongue.

You think $400 a month for rent is way too high.

You know a swamp cooler is not a happy hour drink.

You know the pool can be warmer than you are.

You realize that Valley Fever isn't a disco dance.

Anywhere that takes longer than a 10 minute drive is way too far.

You think you're better than people from Fresno.

Someone mentions the fair and your thoughts turn to Cinnamon Buns, First Christian Church corn on the cob, and Boy Scout potatoes.

You have to "explain" to someone about Beach Park.

You complain about how boring Bakersfield is, but still make fun of people from Delano, Taft and Tehachapi.

Someone from out of town talks about how foggy it is and you tell them, "Just wait."

You swear that just last week there was an orchard where there is now a whole development of houses.

You drive just as fast on a sunny day in June as you do on a foggy day in December.

You know what an 08er is, where the Dale is at, and what a Dalion is.

You actually get these jokes and pass them on to other friends from Bakersfield...

Four New Tracks from "Nemo", Exclusive to Bakotopia

Okay after much editing and reediting of my new tracks "Cell", "Soundscape To Another Life", "Station" & "Tech Tronic Elements". I've released it here first for all of Bako to sample. They're huge soundscapes of techno, trance and idm, with that bass club feel. Most people I've talked to say that some of my tracks are hard to clasify into a specific electronica genre. I think that's a good thing, I've always wanted to make people scratch their heads, while bobbing them. It makes me feel that I've really gone past the edge of where I can go with electronica and I hoping to push it farther. These will be tracks on my future CD "FRAGMENT" which will be the first CD I release available online other then past accomplishments from now defunct MP3.com
